Definition

Assault as defined by Black’s Law Dictionary (7th Edition): 1. Criminal & tort law.  The threat or use of force on another that causes that person to have a reasonable apprehension of imminent harmful or offense contact; the act of putting another person in reason fear or apprehension of an immediate battery by means of an act amounting to an attempt or threat to commit battery.  2. Criminal law .  An attempt to commit battery, requiring the specific intent to cause physical injury.  3. Loosely, a battery.  4. Popularly, any attack.  

Battery as defined by Black’s Law Dictionary (7th Edition): 1. Criminal law.  The application of force to another, resulting in harmful or offensive contact.

Types of Assaults & Penalties under MN Law

1st Degree Assault (Felony, Max. 20 years prison / max. $30,000.00 fine)
2nd Degree Assault (Felony, Max. 7 years prison / max. $14,000.00 ) – with increased prison and/or fines if bodily injury is involved
3rd Degree Assault (Felony, Max. 5 years prison / max. $10,000.00 fine)
4th Degree Assault (Gross Misdemeanor, Max 1 year in jail / max. $3,000.00) – with increased prison and/or fines if bodily injury is involved
5th Degree Assault (Misdemeanor, Max. 90 days in jail / max. $1,000.00 fine for first time offenders) – with increased charges, jail and/or fines for repeat offenders
